MCD Auctions act in their auctions as agents only and neither they, their employees, nor agents can be held responsible for any default by either buyer or seller.
MCD reserve the right to ask overseas bidders, or bidders who have not previously purchased at an MCD auction, to pay a deposit before being permitted to bid. This deposit will be refunded after the auction.
The lots will have a staggered ending on auction day. In this auction, 2 lots will close every minute. Ie. Lots 1 and 2 will close at 12.00pm, then lots 3 and 4 will close at 12.01pm and so on.
In the event of a bid being received within 5 minutes of the scheduled closing time, the bidding period on that lot will automatically extend by 5 minutes and for a further 5 minutes for any subsequent bid received thereafter. Remember to verify that the reserve price has been met before assuming you are successful in buying a lot.
In common with most on-line auctions the online catalogue may be updated regularly until the sale day. All lots are sold as seen, untested and without any warranties whatsoever, either express or implied. All lots are put up for sale on a sold as seen basis subject to any reserve price placed by the vendors who may bid for any lots and may withdraw any lots either personally or through MCD. Vendors occasionally lower reserve prices whilst the auction is in progress, so buyers are advised to regularly check bids that are lower than the reserve price. Viewing & testing is provided for prospective buyers to satisfy themselves about the condition of any lots comprised in the auction. Viewing is at MCD's office and is by appointment only and can be arranged by telephone or email. The purchaser shall be deemed to have inspected the lot(s) he or she buys, or if purchased without previous inspection, it is understood to be at his or her own risk. Any description contained in the catalogue or any warranty which may be given is the sole responsibility of the seller and MCD shall incur no liability to any person in respect thereof. Although no form of warranty is given with any lot, MCD will use their best endeavours to provide the history of any lot. Where engineers reports are available, these will be displayed. MCD recommend that buyers examine lots prior to bidding as no refunds can be given after the sale.
In accordance with the Data Protection Act, software and data may be removed from systems and is not part of the sale unless specified, whereby the buyer would need to obtain the appropriate licence from the software providers prior to use.
All lots sold are subject to a 15% buyers commission and VAT on the hammer price. All lots are subject to the addition of VAT. Payment is by bank transfer only.
MCD reserves the right to reject bidders at any time even if previously approved to bid. MCD aims to notify successful bidders within 1-2 working days of the end of the auction. Purchased lots are the responsibility of the buyer from the moment the lot is shown as sold and MCD shall be under no liability for subsequent loss or damage, however caused. In the event of a third party proving to have title or right to custody or possession of any lot the vendor may rescind the contract of sale and upon return of any deposit or purchase monies to the buyer, neither the vendor nor MCD shall be under any further liability to the buyer.
CONTRACTS
All accepted bids are contracts and are considered final and non withdrawable.
BUYER'S PREMIUM
A buyer's premium of 15% will be applied to all purchases.
ONLINE BIDDING
The person posting the bids online has to be the person who has registered for the auction.
